1. Introduction
Welcome to GiveChangu! These Terms of Service ("Terms") govern your use of the GiveChangu platform,
including our website and services (collectively referred to as the "Platform"). By accessing or using the
Platform, you agree to comply with and be bound by these Terms. If you do not agree with these Terms,
please do not use the Platform.

2. Overview of Services
GiveChangu is an online platform that enables users to create and manage fundraising campaigns and
make donations to support various causes. We aim to facilitate transparent, secure, and effective donations
for charitable causes within Malawi. The Services are Platforms: The Services provided by GiveChangu
are administrative platforms only. We facilitate the fundraiser of the organizers and permit donors to make
donations to these fundraisers. GiveChangu is not a broker, agent, financial institution, creditor, or nonprofit
corporation.

3. Account Registration
3.1. Eligibility: You must be at least 18 years old to create an account on GiveChangu. By registering, you
confirm that you meet this age requirement and have the legal capacity to enter into these Terms.
3.2. Account Information: You agree to provide accurate and complete information during the registration
process and to keep this information up to date. You are responsible for maintaining the confidentiality of
your account credentials and for all activities that occur under your account. GiveChangu is not liable for
any unauthorized access or use of your account.

4. Campaign Creation
4.1. Authenticity and Accuracy: When creating a fundraising campaign, you agree to provide truthful,
accurate, and complete information about the campaign. Misleading or fraudulent campaigns are strictly
prohibited and may result in legal consequences.
4.2. Verification: GiveChangu reserves the right to verify the authenticity of any campaign before
disbursing donated funds. This may include requesting additional documentation, contacting the campaign
organizer, or conducting an on-site inspection.
4.3. Compliance: All campaigns must comply with applicable laws and regulations in Malawi. Campaigns
that promote illegal activities, hate speech, or other harmful content are not allowed.

5. Donations and Fees
5.1. Donations: All donations made through the GiveChangu platform are voluntary and non-refundable,
except as outlined in our Donation Refund Policy. Donors acknowledge that their contributions are made to
support the specified campaigns and that GiveChangu is not responsible for the use of the funds by the
campaign organizer.
5.2. Service Fee: GiveChangu charges a service fee of 4% of the total donation amount. This fee is
automatically deducted from the donation before disbursement to the campaign organizer. The service fee
covers the cost of operating the Platform and providing support to users.
5.3. Payment Processing: GiveChangu partners with third-party payment processors to handle donation
transactions. By using our Platform, you agree to comply with the terms and conditions of these third-party
payment processors. GiveChangu is not responsible for any issues arising from payment processing.

6. Fund Disbursement
6.1. Payout Timing: Funds raised through GiveChangu campaigns will be disbursed to the campaign
organizer after the completion of the verification process. The timing of disbursement may vary depending
on the outcome of the verification process.
6.2. Hold on Funds: GiveChangu reserves the right to place a temporary hold on funds if there are
concerns about the authenticity of the campaign, potential fraud, or violations of these Terms. In such
cases, funds will not be released until the issue is resolved.

7. User Conduct
7.1. Prohibited Activities: Users of the GiveChangu platform agree not to engage in the following
activities:
● Posting or sharing false, misleading, or defamatory information.
● Engaging in fraudulent activities, including misrepresentation of a campaign.
● Violating the intellectual property rights of others.
● Harassing, threatening, or abusing other users or third parties.
● Using the Platform for any illegal or unauthorized purposes.
7.2. Suspension and Termination: GiveChangu reserves the right to suspend or terminate any user
account that violates these Terms or engages in activities that harm the integrity of the Platform.
Suspended or terminated users may be banned from future use of the Platform.

8. Intellectual Property
8.1. Ownership: All content and materials on the GiveChangu platform, including text, images, logos, and
software, are the property of GiveChangu or its licensors and are protected by applicable intellectual
property laws.
8.2. License: GiveChangu grants users a limited, non-exclusive, non-transferable license to access and
use the Platform for its intended purposes. This license does not grant any rights to modify, distribute, or
create derivative works of the Platform content.

9. No Solicitation
The Platform is offered to help organizers raise money. GiveChangu merely provides the technology to
connect fundraisers with donors. The existence of the Services is not a solicitation of donations by
GiveChangu. We do not engage in solicitation activities or consult on the solicitation of contributions from
the public on behalf of any individual, entity, or organization. By using the Services, you understand and
agree that GiveChangu is not responsible for the use of your donations or the amount of funds raised for
any user or fundraiser.

10. Dispute Resolution
10.1. Informal Resolution: In the event of any dispute or disagreement related to the use of the
GiveChangu platform, you agree to first attempt to resolve the issue informally by contacting our support
team.
10.2. Arbitration: If a dispute cannot be resolved informally, it shall be settled by binding arbitration in
accordance with applicable arbitration standards and laws in Malawi. The arbitration process shall be
conducted by a neutral arbitrator, and the decision shall be final and binding on both parties.
10.3. Jurisdiction: These Terms are governed by and construed in accordance with the laws of Malawi.
Any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the
courts of Malawi.

11. Limitation of Liability
11.1. No Warranty: The GiveChangu platform is provided on an "as-is" and "as-available" basis without
any warranties, express or implied. GiveChangu does not guarantee the accuracy, completeness, or
reliability of any content on the Platform.
11.2. Limitation of Damages: To the maximum extent permitted by law, GiveChangu shall not be liable for
any direct, indirect, incidental, consequential, or punitive damages arising out of or related to the use of the
Platform, including but not limited to lost profits, loss of data, or business interruption.
